China Trailer AD/CVD Final Findings Published; UAE Steel Pipe Review Amended

Van-type trailers and their subassemblies are the subject of the newly published Commerce determinations.

Commerce’s August 31 publications put its China van-type trailer investigations at the final-determination stage, including a 134.75% final subsidy rate. That figure is not a universal cash-deposit rate starting today: the countervailing-duty notice ties deposits at the final rate to an order following an affirmative final injury finding. China van-type trailers: higher final subsidy findings, with an injury decision still ahead

The two affirmative final determinations were signed August 24, filed August 28 at 8:45 a.m., and published with an applicable date of August 31, 2026. The new development is the formal publication of Commerce’s final findings; issuance of AD/CVD orders still depends on the U.S. International Trade Commission’s final injury determination. For CVD, the earlier findings were 82.37% for CIMC and all others and 128.78% for the listed non-responsive companies. CIMC is the combined respondent comprising CIMC Baowell Industries Co., Ltd. and Qingdao CIMC Reefer Trailer Co., Ltd. After it withdrew before verification, Commerce used adverse facts available—an approach that permits unfavorable inferences from available evidence when a party does not fully cooperate. The higher final findings warrant a reassessment of duty exposure, but should not be substituted automatically for the deposit instructions applicable to a particular entry. Scope and the Canada filing route

The written scope covers specified enclosed cargo trailers with a gross vehicle weight rating greater than 26,000 pounds, plus covered subassemblies, whether finished, unfinished, assembled, or unassembled. Main HTSUS references are 8716.39.0040, 8716.39.0090, and 8716.90.5060; other listed headings can cover subassemblies. Classification alone does not decide coverage. Further processing in a third country does not remove an otherwise covered product from scope, while subassemblies covered by the existing China chassis orders are expressly excluded. The final notices carry forward Canada third-country ACE case numbers A-122-219 and C-122-218. For covered trailers containing Chinese subassemblies imported through Canada, the China duties attach to the Chinese subassembly portion and components entering on the same bill of lading as that subassembly—not automatically to the entire Canadian trailer. UAE steel pipe: Universal’s historical margin amended to 3.64%

Commerce’s August 31 notice amends the 2020–2021 review of circular welded carbon-quality steel pipe from the United Arab Emirates, case A-520-807. The dumping margin for Universal rises from 2.63% to 3.64%. The amendment follows the Court of International Trade’s August 19 judgment, was signed August 26, and specifies an applicable date of August 29, 2026. Universal comprises Universal Tube and Plastic Industries, Ltd.; THL Tube and Pipe Industries LLC; and KHK Scaffolding and Formwork LLC. The review covers December 1, 2020–November 30, 2021. This is a historical assessment issue, not a new deposit rate for current shipments: a later review already supplies Universal’s superseding cash-deposit rate. Covered entries remain subject to the court’s liquidation injunction during any appeal; eventual assessment is to follow importer-specific instructions after a conclusive court outcome. Bulk-power equipment: the published order is EO 14421

The August 31 Federal Register publishes the August 26 bulk-power-system action as Executive Order 14421, 91 FR 55995. This supplies a formal citation for the action previously announced on the White House website. The White House page still labels the same titled action EO 14420, so the two official records remain inconsistent. The development today is formal publication and citation clarity, not an additional blanket import ban. Section 2 makes the prohibition for transactions initiated after the order dependent on Energy Department findings involving a Covered Foreign Entity and specified security risks. Equipment procurement reviews should account for associated software, firmware, maintenance, and remote access as well as hardware. EO 14421, section 2.

Actions for importers and customs brokers

  1. Separate trailer exposure estimates from entry deposits. Update the final-rate scenario in costing files, but match each entry to the applicable producer/exporter combination, case number, entry date, and deposit instruction. Do not add the two headline findings together and label the result today’s universal payable rate. AD provisions · CVD provisions.
  2. Reconcile Universal’s historical entry population with counsel. Review assessment exposure and injunction coverage without overwriting the current-shipment deposit master. Escalate the notice’s impossible date range before using it in a liquidation workflow. Pipe review amendment.
  3. Attach the published power-system order to procurement reviews. Record EO 14421 as shown in the Federal Register, retain the White House discrepancy, and map suppliers’ software and service dependencies for any future DOE determination. Published order.

  • Trailers: the ITC’s final injury decision, which Commerce says is due within 45 days of its final determination; then any AD/CVD orders and entry instructions. Questions and answers

Can a Canadian assembly step put a trailer outside the China cases?

Not by itself. The written scope covers third-country processing, and the notices give specific Canada case-reporting and covered-value rules. Trace the Chinese subassemblies and accompanying components rather than relying only on the final shipping country. Scope and Canada provisions.

Does a cash deposit settle the final amount of duty?

No. The notices distinguish deposits for estimated duties from later assessment instructions. For Universal’s pipe entries, Commerce specifically calls for importer-specific assessment after a conclusive court outcome; the published company margin is not a blanket instruction to liquidate every entry at that percentage. Is there a route to pre-qualified status for power-equipment vendors?

The order authorizes DOE to establish criteria, procedures, and lists for pre-qualified equipment and vendors, exempting qualifying future transactions from section 2(a). That authority is not a vendor’s self-certification, and the order preserves DOE’s ability to regulate transactions involving qualified equipment or suppliers. Section 2(e).
